Missouri Medical Marijuana’s Laws 2022

At this point, adult-use cannabis is illegal in Missouri. However, medical marijuana in Missouri is legal for those who have a qualifying condition. Qualifying conditions include the following:

  • Alzheimer’s disease
  • Terminal illnesses
  • Autism
  • Cancer
  • Crohn’s disease
  • Chronic pain/neuropathy
  • Epilepsy
  • Glaucoma
  • Hepatitis C
  • HIV/AIDS or cachexia or wasting syndrome
  • Huntington’s disease
  • IBS
  • Intractable migraines
  • Lou Gehrig’s disease
  • Multiple Sclerosis
  • Opioid substitution
  • Parkinson’s disease
  • PTSD or other “debilitating psychiatric disorders”
  • Tourette syndrome
  • Sickle cell anemia
  • Seizures
  • All “other chronic, debilitating or other medical” conditions that may receive relief through marijuana treatment “in the professional judgment of a physician”

Patients are allowed to buy up to four ounces of cannabis every 30 days. However, the Department of Health can set its own limits regarding how much cannabis can be possessed if “the limit is not less than a 60 days supply.”

The law has given Missouri’s Department of Health and Senior Services (DHSS) the task of issuing licenses to patients that qualify. It also has been given the responsibility of licensing facilities to serve medical cannabis, which includes the state’s dispensaries.

Missouri allows state-licensed dispensaries. The state also currently has operational state-licensed dispensaries.

As of January 3, 2022, the state estimates it has 161,032 registered cannabis patients.

Compliance regulations impact how these operations run. For compliance purposes, the DHSS’s regulations require all dispensaries to use a certified seed-to-sale system for inventory tracking and reporting to the state.

Missouri Medical Marijuanas Application

To apply for a Missouri medical marijuanas card, patients must first register with the state. This is through the Missouri Department of Health & Senior Services.

Patients must obtain a Physician Certification Form and have it completed by a DO or MD with a current license valid in Missouri. Any patient that wants to obtain the standard recommended dose of four ounces monthly will need to use the Standard Physician Certification Form.

If a patient needs more than four ounces per month, they will have to use the Alternative Physician Certification Form. This involves submitting two of these forms filled out by two different physicians. They’ll need to have the same qualifying condition selected for each of the forms, as well. Any inconsistencies in physician recommendations will result in the patient being allowed the lesser of either amount.

Minor patients will need to complete and submit a Parent/Legal Guardian Consent Form, as well. Caregivers applying must have a Patient Authorization Form that includes the patient’s license number. The patient receives this number after their application approval.

Next, patients must register with the Complia application portal. The applications must be submitted through the online registry to get acceptance.

After registering, patients must complete an application. This involves logging into the Complia portal and creating an application as a new patient registration.

Caregivers who have registered must also complete an application in the Complia portal. The main difference is they will need to register as a new caregiver.
